SimplyBorrowed Inc. · Version 2026-10-23 · Effective October 23, 2026 for new customers and November 22, 2026 for existing customers
These Terms govern the SimplyBorrowed customer portal and the application and account services available through it (the Service), offered by SimplyBorrowed Inc., 231 Oak Park Blvd, Suite 301, Oakville, ON L6H 7S8. Before creating an account or applying for a loan, you will be asked to accept these Terms.
Our Privacy Policy (https://simplyborrowed.ca/privacy-policy/) explains how we handle personal information. Accepting these Terms is not consent to optional marketing and does not replace the separate authorisations required for credit inquiries or banking access.
1. Application eligibility
To apply for a loan, you must be at least 18 years old, reside in Ontario and meet our eligibility and underwriting criteria. Eligible status categories are Canadian citizens, permanent residents, recognised refugees and protected persons, refugee claimants awaiting a decision, and temporary residents holding a valid work permit or study permit.
You must provide a valid document confirming your current eligible status. Applicants relying on maintained status while awaiting a permit extension decision are not currently eligible under our criteria. These are SimplyBorrowed’s requirements, not a statement that Canadian law prohibits lending to people on maintained status.
We may request information reasonably necessary to verify your identity and eligibility. Contact info@simplyborrowed.ca about acceptable evidence. Eligibility for a new application is separate from servicing an existing loan; a change in status does not remove servicing access or change your obligations under an existing loan agreement.
2. Your account
Provide accurate, complete and current information and update it when it changes. Keep your login credentials confidential and use the security features provided. Tell us promptly at info@simplyborrowed.ca if you suspect unauthorised access.
We may temporarily restrict access where reasonably necessary to protect your account or the Service. You can contact us about your loan while access is restricted. These responsibilities do not make you automatically liable for every unauthorised activity or limit your rights under applicable law.
3. Applying for a loan
Applying does not guarantee a loan. We assess applications against our criteria and may decline an application or offer different terms. We verify identity and eligibility, review banking information retrieved through Zum Rails with your authorisation and, only after your express consent, obtain an Equifax credit report during the application. We may request additional documents.
We use automated systems and AI tools as described in section 4 of our Privacy Policy. The system can decline an application automatically, for example when Equifax has no credit file for you, when you decline the credit check, or when an application is not completed within the time allowed. Every loan approval and release of funds requires individual staff approval. Standard offers are approved in advance rather than individually each time. You can request a staff review at info@simplyborrowed.ca; the same criteria apply and a review does not guarantee a different outcome.
If we decline an application wholly or partly because of information from a consumer reporting agency, we tell you when we communicate the decision. If you ask within 60 days, we give you the name and address of the agency, as required by the Ontario Consumer Reporting Act.
Your signed loan agreement governs the amount borrowed, cost of borrowing, repayment obligations and other loan terms. If these Terms conflict with that agreement on a matter concerning your loan, the loan agreement prevails, subject to applicable law. Accepting these Terms does not amend an existing loan agreement or authorise a debit from your bank account.
Pre-authorised debits are governed by your PAD authorisation. You may cancel it in accordance with its terms and applicable rules. Cancelling it does not cancel the loan or the amount owed; contact info@simplyborrowed.ca to arrange another payment method.
4. Documents and information you provide
You confirm that the information you provide is accurate and complete to the best of your knowledge and that documents are genuine and have not been misleadingly altered. You must be entitled to provide them. Tell us promptly if you discover a material error.
We handle information for the purposes in our Privacy Policy, subject to consent requirements and legal restrictions. If information is materially inaccurate, incomplete or suspected to be fraudulent, we may request clarification, pause an application or restrict access while we investigate. Deliberately false or fraudulent submissions may lead to a declined application or to restriction, suspension or closure of portal access. We may disclose relevant information where authorised or required by law. Where appropriate and lawful, we give you an opportunity to clarify an apparent error. Section 10 governs the effect on existing loans.
5. Electronic communications and documents
By accepting these Terms, you consent to electronic delivery of account and loan communications where permitted by law. Your signed loan agreement is emailed to you through DocuSign and is also available to download from the portal. Other communications may be sent by email or text message.
Contracts are currently the only documents available to download from the portal. You may request your payment history, outstanding balance and paper copies of loan documents by emailing info@simplyborrowed.ca.
Keep your contact information current, keep copies of documents you need and tell us promptly if you cannot access a document or believe delivery has failed. Contact info@simplyborrowed.ca for assistance, a paper copy or to discuss withdrawing consent to electronic delivery. When a document requires a signature, we ask you to sign that document through the applicable process; accepting these Terms does not sign a future loan agreement.
6. Acceptable use
Do not use the Service to break the law, impersonate another person, access another person’s account or information without authorisation, interfere with the Service or its security, or collect information about other users without a lawful basis.
7. Our content and your records
The Service, its design and proprietary content belong to SimplyBorrowed or its licensors. You may use them for personal purposes to learn about our products, apply for a loan and manage your account and loans. You may download available documents and keep and share your own agreements, statements, payment records and communications, including with professional advisers. Other use of our proprietary content requires our permission or another lawful basis.
8. Availability and payment difficulties
We work to keep the Service available and accurate, but maintenance, technical problems or other circumstances may interrupt it. An interruption does not automatically change the payment schedule in your loan agreement. If it prevents payment or access to documents, contact info@simplyborrowed.ca promptly; alternative arrangements are available for payments and loan documents.
We investigate fees, charges or inaccurate payment records that you reasonably believe resulted from a failure of our systems and correct errors attributable to that failure. We do not currently report to credit bureaus. Your statutory rights are unaffected.
9. Liability
To the extent permitted by applicable law, SimplyBorrowed excludes liability for indirect or consequential losses arising from use of the Service. This exclusion does not apply to fraud or wilful misconduct by SimplyBorrowed, does not limit liability that cannot lawfully be excluded and does not restrict any non-waivable consumer or privacy right. Nothing in these Terms releases SimplyBorrowed from its obligations under your loan agreement.
10. Account closure and restricted access
When all your loans are paid in full, you may close your portal account by emailing info@simplyborrowed.ca, or delete your information from your profile page. Voluntary closure is not available while a loan remains outstanding.
We may restrict, suspend or close portal access where reasonably necessary to address a material breach of these Terms, suspected fraud, a security risk or a legal requirement. Where reasonably possible and lawful, we give notice and an opportunity to address the issue. Restriction, suspension or closure does not accelerate, cancel or otherwise change a loan; the loan agreement continues to govern repayment. Contact info@simplyborrowed.ca for alternative arrangements for payments, loan documents, complaints and privacy requests.
Account closure and deletion of personal information are separate. You may make a privacy or deletion request while a loan remains outstanding, subject to the retention purposes in our Privacy Policy. Neither cancels a debt.
11. Changes to these Terms
We notify affected customers by email or through a prominent portal notice at least 30 days before a material change takes effect. The notice explains the change, its effective date and whether acceptance is required. Where acceptance is required, we ask for it expressly, including when you next sign in.
If you do not accept revised Terms, you may continue to use the portal to service existing loans under the Terms you previously accepted. New loan applications require acceptance of the revised Terms. A revision does not amend a loan agreement or authorise a new use of personal information; any required loan amendment or privacy consent is handled separately. If a change is required sooner by law or to address an urgent security issue, we give as much notice as reasonably possible.
12. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, subject to any mandatory rights or protections that apply.

14. Questions and complaints
For a complaint about an application, account or loan, email info@simplyborrowed.ca, explaining what happened and the outcome you are seeking. We investigate and explain our response and any internal escalation route. Privacy complaints may be addressed to the Privacy Officer at the same address. Our internal process does not limit your right to seek legal advice, contact a regulator or exercise your legal rights.
